Terms of Sale & Use

1.Purpose

The purpose of these general conditions of sale is to define the rights and obligations of ICON COLLECTION and of the customers of products offered by ICON COLLECTION on its website www.atelier-cara.com (hereinafter "the Site"). They apply exclusively between ICON COLLECTION L.L.C-FZ, Meydan Grandstand, 6th Floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E. and any natural person or customer visiting or making a purchase via said Site (hereinafter "the Customer").

Every order placed on ICON COLLECTION entails the customer's full acceptance of these general conditions of sale without reservation. These general conditions of sale can be modified at any time and without notice by ICON COLLECTION; the applicable conditions are those in effect at the date the order was placed.

2.Ordering Products

2.1 Ordering online — The products for sale are presented on the Site with a description. Elements such as pictures, texts, graphics, and all information and features illustrating or accompanying the products are not contractual. In accordance with article 1369-2 of the civil code, the customer will have the possibility of verifying the details of the order and the total price, and to correct any errors before finally validating the order.

2.2 Refusal of orders — According to article L.122-1 of the Consumer Code, ICON COLLECTION is entitled to refuse any abnormal order or an order placed in bad faith.

3.Customer's Obligations

3.1 Minimum age — The customer must be legally able to enter into a binding legal agreement (typically 18 years of age or older, depending on where the customer lives) in order to purchase products.

3.2 Accuracy of information — The customer agrees to communicate accurate information necessary for the realisation of the service, including valid name, address, telephone number, email, and all information related to the vehicle. The customer is responsible for the consequences arising from transmitting false or inaccurate information. Once the order has been placed, ICON COLLECTION will send a confirmation email to the customer.

4.Price and Taxes

4.1 Price — Prices displayed on the site are indicated in Euros, French taxes included, inclusive of shipping charges. Prices may be modified at any time without prior notice. Items are charged on the basis of rates in effect at the moment the order was placed. For customised versions, prices are submitted via a quote which requires prior customer acceptance.

4.2 Taxes — The customer is solely responsible for determining applicable national, state, and local taxes and duties in their jurisdiction and for ensuring compliance with applicable tax laws.

5.Delivery

The average delivery time is 3 weeks. CARA Paris engages to inform the customer of the final delivery date. Delivery timelines for made-to-order creations may vary and will be communicated individually.

6.Payment

The totality of payment must be made when the order is placed. The customer may pay by credit card (Visa, Eurocard/Mastercard) or by bank transfer. Communication of the credit card number authorises ICON COLLECTION to debit the account with the amount of the order. ICON COLLECTION retains the product until the totality of payment has been received. All transactions are processed securely.

7.Returns and Refund

Each creation is customised and specifically manufactured for each customer. There will be no returns for any orders from www.atelier-cara.com. Each creation undergoes thorough quality control and is carefully manufactured.

In the exceptional event of a product defect upon reception, please inform the ICON COLLECTION team as soon as possible. In case of damage upon reception, please contact us within 72 hours at: contact@atelier-cara.com

8.Warranty and Liability

A two-year warranty from the date of purchase covers any manufacturer's defects in material and physical workmanship. This warranty is conditional upon the product being used under normal circumstances and being properly cared for. Excluded from the warranty are damages associated with wear and tear from daily use, or scratches and dents due to road imperfections.

If the product is modified in any way or serviced by anyone other than ICON COLLECTION or the manufacturer, this warranty will immediately cease to apply. Any alteration, change, or modification to CARA Paris products will cancel the warranty.

9.Force Majeure

In case of force majeure, the concerned party must inform the other within 15 days from the occurrence of the event, via registered letter with acknowledgment of receipt. All obligations of both parties will be suspended for the duration of the force majeure, without compensation. If the force majeure extends for more than 3 months, the contract may be terminated automatically with no compensation for either party.

10.Applicable Law

These general conditions of sale are subject to French law. In case of difficulty, the customer may seek a friendly resolution before initiating legal proceedings. Any dispute arising from the interpretation or execution of these general conditions of sale shall be subject to the exclusive jurisdiction of the French tribunal.

2.Updates

ICON COLLECTION may change the terms of use at any time and publish an updated version. You accept to abide by any subsequent update. We invite you to consult this page regularly to remain informed of the current applicable conditions.

3.Personal Data

All data we collect is stored in our files and will never be given, rented, or sold to any third party. When you create a customer account, we save the information necessary to process your order: your email, name, address, phone number, and vehicle information. For credit card payments, we work with Stripe, a globally recognised payment provider that guarantees the security of your data. We do not have access to your credit card number at any time.

4.Liability — Disclaimer of Warranty

ICON COLLECTION makes its best efforts to provide accurate and up-to-date information, but makes no warranties of any kind, express or implied, regarding the content of the Site, which is provided on an "as is" basis. ICON COLLECTION shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use of, access to, or inability to use the information or products offered on the Site.

5.Intellectual Property

You may not copy, modify, download, or transmit the intellectual property presented on this site for commercial purposes. Failure to comply with these Terms of Use will constitute a breach of contract and copyright infringement.

6.Third-Party Links

ICON COLLECTION cannot be held responsible, directly or indirectly, for the accuracy, validity, suitability, legality, or other qualities of any information or documents appearing on third-party sites linked from this website.
